Construction Law and Litigation

Practice Area

Coleman Talley’s Construction Law and Litigation Practice Group provides representation to clients in all aspects of the construction industry, including developers, design professionals, engineers, general contractors, subcontractors, suppliers, program managers, construction managers, both public and private owners, and surety companies.

Among the services provided by the lawyers in Coleman Talley’s Construction Law and Litigation Practice are the following:

CONTRACT DRAFTING, REVIEW AND NEGOTIATION

A substantial portion of our practice is devoted to assisting the firm’s clients in avoiding disputes through effective contract drafting and negotiation. We routinely draft, review, edit, and negotiate agreements for clients involved in all facets of the construction industry.

CONSULTATION DURING THE CONSTRUCTION PROCESS

It is often said that an ounce of prevention is worth a pound of cure, and this is certainly the case when it comes to construction disputes. By assisting clients in addressing matters relating to notice, claims, delays, defective work, termination, and others early in the process, we are oftentimes able to help our clients mitigate the impact of various issues encountered during the course of construction, and in some instances, avoid disputes altogether.

Similarly, we frequently assist our clients during the close-out process of a construction project. In this regard, we can assist our construction industry clients in their efforts to ensure that construction is completed (i) on-time and under budget, (ii) in a good and workmanlike manner, (iii) on a lien-free basis, and (iv) without the need for litigation or alternative dispute resolution methods.

CONSTRUCTION LITIGATION

Our trial lawyers have substantial experience in adjudicating construction disputes in all types of forums. Whether in State or Federal Court or before an arbitration panel constituted under any number of industry rules or organizations, we are well equipped to represent our construction industry clients in a professional and cost effective manner.
