On March 24, 2023, Governor DeSantis signed into law HB 837 which represents extensive tort reform in Florida. While the bill is far-reaching, a portion of the legislation affects Florida’s multifamily property owners and operators. Specifically, where multifamily property owners and operators implement certain security measures at their properties, the bill serves to shift the burden of proof in favor of the property owner or operator in claims that are based upon criminal acts occurring on the property. Where the specific security measures are implemented, there is a presumption against liability of the owner or operator of the multifamily property.
