University Housing Development Law

Coleman Talley’s University Housing Practice Group represents developers, universities, equity investors, property managers, and lenders in a variety of university housing transactions. We have experience in the structure and closing of transactions financed both conventionally and through government-subsidized sources, including tax-exempt bonds (with and without credit enhancements) and other mixed finance sources, and conventional acquisition, bridge construction, and permanent financing. We regularly assist clients in all aspects of the student housing development process, including:

  • The structure, formation, organization, and negotiation of joint ventures
  • Acquisition and development, including site control (real estate contracts, land leases and options), property due diligence (title, easements, land use, survey, zoning, environmental regulations), closing of real estate purchases, drafting and negotiation of development agreements and of third party construction, architect, and engineering contracts
  • Drafting, review, and negotiation of debt and equity financing documents
  • Preparation and negotiation of property management and operating documents
  • Drafting, review, and negotiation of construction contracts, architect’s and engineer’s agreements

  • Capital planning and advice regarding relations with local boards and authorities
